Preamble

By accessing and using our Site or any of our applications, whether as an Internet User, User or Client, you acknowledge having read, understood and accepted to be bound by the present Terms and Conditions.

You agree to use our Site only for legal purposes.

If you do not agree to these Terms and Conditions, you must not use the Site or buy any of our Services.

MEET THE LOCALS reserves the right to amend these Terms and Conditions at any time for technical, economic, legal or commercial reasons, such as the launch of new Services.

Any modification of these provisions shall be the subject of a notice that will appear on our Site.

The latest version of the Terms and Conditions shall be made available at all times and in free access on the Site.

Any booking made through our Site implies full acceptance of these Terms and Conditions.

Definitions

These Terms and Conditions shall govern the use of the Site and the access by Users or Guests to the Services on this Site.

The following terminology applies to these Terms and Conditions:

Accountmeans the online account created by any Internet User to access and buy Services, as the case may be. The Account compiles all information provided by the Client and required by MEET THE LOCALS to deliver the Services.
Clientmeans any User making a Reservation through the Site.
Internet Usermeans any person visiting the Site.
MEET THE LOCALSmeans our company whose details are described in legal information.
Reservationmeans the booking of an Activity made by a Client on the Site.
Servicemeans the services provided on the Site by MEET THE LOCALS allowing Users to select an Activity and make a Reservation.
Sitemeans MEET THE LOCAL’S website (www.meet-thelocals.com).
Terms and Conditionsmeans the presents legal terms and conditions.
Activitymeans an activity proposed on the Site, that can be reserved by Users such as Entrance Tickets, touristic visits, walks, excursions, recreational, cultural and gastronomic moments, lessons, personal concierge, etc.
Usermeans any Internet User who creates an Account.
Voucher

means a receipt of Reservation sent by email to the Client and mentioning all useful references to the Activity such as descriptive, Reservation number, Activity dates, meeting point with the Welcomer, telephone number to contact in case of a problem or emergency, etc.

The Voucher is provided immediately after the Reservation of a Service paid by the Client.

Welcomer

means any qualified guide carefully selected by MEET THE LOCALS whose profile and Activity’s description are accessible to all Internet User and for which any User can make a Reservation on the Site.

All Welcomers have signed a charter under which they shall perform their activities.

Access & Account

Any Internet User can access the Site at no additional cost.

MEET THE LOCALS shall not be liable if for any reason our Site is unavailable at any time.

The User status is obtained by creating an Account by completing the required fields on the profile page. The information provided by the User must be correct and up to date and can be modified at any time if necessary.

The username and password selected by the User shall not violate the rights of third parties – especially the rights related to family names or brands – or be offensive.

When the Account is registered, the User will receive an email of confirmation on the email address associated with the Account. The User identification code and password (“Login Information”) will be required to get access to his/her Account. Such Login Information is personal and confidential and should not be disclosed to any third party.

The User undertakes to:

  1. Have only one Account on the Site,
  2. Use this Account for personal use only, all acts performed under this Login Information being assumed to have been carried out by the User,
  • Regularly update his/her personal information,
  1. Not transfer his/her Account to a third party or another User,
  2. Keep confidential his/her Login Information. In the event that this Login Information is forgotten or in the case of an unauthorized or abusive use of this Login Information, under no circumstance shall MEET THE LOCALS be held liable and the User shall immediately notify Us of this situation, by email sent to: hello@meet-thelocals.com

MEET THE LOCALS shall remove the user’s personal information in accordance with its policy of personal information management set out below.

MEET THE LOCALS reserves the right to remove a User Account, especially if:

  1. The User violates any of the Terms and Conditions.
  2. MEET THE LOCALS notices that there was no connection on the User Account for a period of three (3) years and after a reminder email was sent but no response was given within ten (10)

The user may unsubscribe from MEET THE LOCALS by deactivating his/her account at any time. This can be done on the site page of his/her personal account. All account deactivations on the MEET THE LOCALS site take effect immediately.

Services

Publishing MEET THE LOCALS Activities

Activities selected by MEET THE LOCALS and/or activities proposed by Welcomers include for example Entrance Tickets, visits, walks, excursions, recreational, cultural and gastronomic Activities, personal concierge etc.

MEET THE LOCALS then publishes descriptions of such Activities and of the corresponding Welcomer’s profile on the Site in order for any interested User to make a Reservation.

Every Activity published on the Site shall contain specific information such as the title of the activity, where it will take place, its description, the public for which it is intended, prospective restrictions, the availability of the Welcomer, itineraries, images and videos of the Activity, the price and any additional expenses and discounts, etc.

Reservation Process

MEET THE LOCALS provides an ergonomic booking process on the Site.

The selection of an Activity is made by filling in the search criteria on the Site.

Should the User be interested in making a Reservation for an Activity, he/she will select any relevant criteria and provide any requested information on the Site (such as number of attendees, date, etc.) by following the Reservation process.

Users can use a set of filters allowing them to optimally target their specific Activity search. The results are ranked in order of relevance with the criteria selected by the User.

 Once the purchase is validated, the User will receive a confirmation by email which also includes the Voucher

Availability

MEET THE LOCALS promptly updates the availability of the Activities. However, MEET THE LOCALS cannot guarantee the availability of each Activity for all proposed dates until the Client receives a confirmation email.

Certain Activities may be subject to restrictions (age, health, etc.) and it is up to the Users to verify if they duly comply with any restrictions imposed by the Activity they chose.

MEET THE LOCALS ensures access to all or part of the Activities by persons with reduced mobility. All persons with reduced mobility must be accompanied by an able person during the entire Activity. The accompanying person must also have a Reservation in due form.

Prices

Unless otherwise stated, prices indicated are the lowest per group and inclusive of tax. Price may be higher for groups over than 4 people, depending on the activities.

Prices are specified on the Site in the currency requested by the User among those proposed, it being duly specified that this involves conversion of the price defined in the currency accepted by MEET THE LOCALS, at the exchange rate on the date of viewing by the Users.

The price and any additional expenses as well as available discount for the Activity must be specified in the Activity offer on the Site. Meet the Locals shall not charge any other additional costs if they have not been published.

Prices published on the Site may be changed without notice, and only become final and binding once the Reservation is completed. Our prices include a 20% VAT.

Reservation is confirmed to the User once the payment process is successfully authorized by the Client’s bank.

MEET THE LOCALS provides a secured online payment system for any payment made on the Site.

Payment is made in Euros (local currency in France) for Paris activities, and Pounds (local currency in England) for London activities)

Users acknowledge that certain transactions may involve bank fees. Users therefore have to contact their bank in order to know the amounts and conditions thereof.

Once the payment is effective, a recap email containing the Voucher and the booking number is sent to the Client.

Withdrawal

In accordance with Article L 121-28 of the French Consumer Code (Code de Consommation), the right of withdrawal cannot be exercised for contracts “for accommodation services, other than residential accommodation, freight transport services, car hire, for meals or leisure activities which are to be provided on a specified date or during a specified period”.

Inasmuch as the Reservation relates to tourism, leisure and recreational activities which are to be provided on a specified date or during a specified period, the Client therefore does not have any right of withdrawal.

Activity dates and number of attendees changing

Clients may change their Reservation up to 72 hours before the beginning of the Activity.

Such modifications are limited to dates and number of attendees.

No modifications can be made less than 72 hours before the beginning of the Activity.

MEET THE LOCALS cannot guarantee the Welcomers’ availability on the new dates requested by the Client or if there are places still available for the relevant Activity.

Any change will be confirmed by the sending of a new Voucher.

Cancellation

In the event of a cancellation, the Client must send an email with the detail of the Reservation (such as the Reservation number, User’s name, date of the Activity, etc.) to the following email address: hello@meet-thelocals.com

For Paris

  • Should the cancellation occur more than 7 days before the beginning of the Activity, we will refund you the full amount of the Reservation, Except for the tours with tickets, on which we retain 20% to cover their reservation cost.*
  • Should the cancellation occur between 7 days and 48 hours before the beginning of the Activity, we will refund you 50% of the Reservation.
  • We will not make any refund for cancellations occurring less than 48 hours before the beginning of the Activity.

For Workshops and Classes:

  • Should the cancellation occur at least 10 days before the beginning of the Activity, we will refund you 50% of the reservation.
  • We will not make any refund for cancellations occurring less than 10 days before the beginning of the Activity.

For cruises, Tuk-tuk & Sidecar:

  • Should the cancellation occur 10 days before your tour, we will refund you the full amount of the Reservation.
  • Should the cancellation occur between 10 days and 5 days before your tour, we will refund you 50% of the Reservation.
  • We will not make any refund for cancellations occurring less than 5 days before the beginning of your tour.

*The Eiffel Tower  activities are not refundable

* Should the cancellation occur because of border closing, we will fully refund you the amount of the reservation.

For London

  • Should the cancellation occur more than 14 days before the beginning of the Activity, we will refund you the full amount of the Reservation, Except for the tours with tickets, on which we retain 25% to cover their reservation cost.
  • Should the cancellation occur between 14 and 7 days before the beginning of the Activity, we will refund you 50% of the Reservation.
  • We will not make any refund for cancellations occurring less than 6 days before the beginning of the Activity.

For Workshops and Classes:

  • Should the cancellation occur 7 days before the beginning of the Activity, we will refund you 50% of the reservation.
  • We will not make any refund for cancellations occurring less than 7 days before the beginning of the Activity.

If the Client has to interrupt the Activity, no refund will be granted.

If the Client arrives more than 30 minutes after the beginning of the Activity, he will be considered as absent and no refund or credit note will be granted.

Intellectual property Rights

MEET THE LOCALS owns or holds the intellectual property rights on the Site including all texts, comments, works, illustrations, logos, icons, or graphics or design, architecture, software, video, images, music, etc. whether visual or audio, contained on the Site as well as databases for which it has the status of producer according to the Code of Intellectual Property (the “Site Elements“).

All Site Elements are protected worldwide by copyright and/or trademark and/or sui generis database rights. MEET THE LOCALS shall take any action necessary to preserve its rights and interests against anyone who proceeds without its prior written consent to the reproduction, representation, translation, retrieval, adaptation, or dissemination in any manner of all or part of the Site Elements.

Personal Data

MEET THE LOCALS considers the Users’ protection of personal data as a priority in its capacity of “Data controller” within the meaning of Law No. 78-17 of 6 January 1978, “Informatique et Libertés” (the “Data Protection Act”).

Personal data provided by Users is collected for the provision of Services available on the Site (names, postal and email address, bank information, etc.).

For this reason and in particular to simplify the User’s access to his/her Account and the Services during the User’s visits after a first connection to the Site, MEET THE LOCALS also uses cookies, which remain on the User’s computer disk drive once its browser is closed. Users can always manually delete these cookies by following the procedures implemented by its browser.

MEET THE LOCALS also uses so-called “session” cookies required to analyse the use and structure of the Site in order to continuously improve the Services and technical means available to Users of the Site.

MEET THE LOCALS does not use these monitoring tools to transmit this data to third parties or marketing platforms, or to link the data with personal data (name, address, etc.) without the express consent of the User.

Google Analytics is the most popular tool for understanding how Users are using our Site. This enables us to better measure, anticipate, and meet or exceed our users’ needs. We do not collect or store your personal information and we cannot use them to identify who you are.

The User expressly acknowledges and agrees that some of the personal data collected by MEET THE LOCALS for the management of its Activity and Reservation requests related to it require communication to Welcomers of some of the data such as names, mail, email and phone details, name and precise locations, with the notable exception of banking information.

Users are aware that the international dimension of the Site may require MEET THE LOCALS to communicate this data to persons residing in countries outside of the European Union and in which the management of personal data is not as protective.

Acceptance of the Terms and Conditions results in a formal and complete acceptance of these transfers.

The processing of Users’ personal data by MEET THE LOCALS through the Site has been declared to the Commission Nationale Informatique et Libertés (CNIL) under the number 2015787 v 0.

As such, MEET THE LOCALS ensures strict compliance with the Data Protection Act and allows any User, in accordance with Article 34 of this Act, to access, modify, rectify and delete data concerning he/she by sending an email to: hello@meet-thelocals.com

Liability

MEET THE LOCALS shall not guarantee to the User that the Services on the Site shall be free from flaws, errors or defects or that they are likely to meet the expectations and constraints specific to each User. It reserves the right to temporarily suspend access to the Site or certain features including improvement or corrective maintenance operations specific to its operation.

MEET THE LOCALS:

  • Will under no circumstances be held liable in case of total or partial suspension of its Services in cases of force majeure, enforcement of a judicial or administrative decision or disruption of telecommunications, computer and / or phone networks, and
  • Disclaims any responsibility for the potential loss of information relating to Users on the Site and recommends that they regularly backup this information.
  • Is not liable in the event of a pirating of the MEET THE LOCALS site.

Pursuant to Article 6-I of the law No. 2004-575 of June 21, 2004 relating to confidence in the digital economy, MEET THE LOCALS shall be held liable only if it has been notified of the illegal nature of activities or information stored by a User on the Site.

MEET THE LOCALS therefore reserves the right to remove any Account in violation of any legal or regulatory provisions or contrary to the Terms and Conditions.

MEET THE LOCALS’ liability is expressly limited to cases of breach of the Terms and Conditions and as such only has an obligation of means which Users expressly acknowledge.

Clients are responsible for their correct behaviour during an Activity and, in particular, agree to act in accordance with the current legislation and to not commit any act that may be considered illegal.

Persons accompanying children and / or persons with reduced mobility during the Activities are fully responsible for the persons in their care, custody and supervision and management.

MEET THE LOCALS will not assume any liability for any damages, material or immaterial, direct or indirect, due to inappropriate conduct or fault of the Client or of a person under their care.

Any Client whose behaviour during the delivery of the Services or during an Activity is in violation of any provisions of the Terms and Conditions or that would have resulted in harm or a risk of harm to the safety of other Users or Clients will see his/her Account immediately closed without the possibility for this User to request a compensation of any kind whatsoever.

Clients who cause any damages will have to reimburse the full cost of the damage caused to the Welcomer, person and / or entity to whom said damage may have been caused. In addition, they are to indemnify MEET THE LOCALS for the full amount of any claims presented against MEET THE LOCALS by any third parties as a consequence of said damage.

Insurance

MEET THE LOCALS is covered by professional insurers, which covers civil liabilities to third parties, arising from bodily injury, property damage, or other wrongs due to the action or inaction of the insured. It covers only civil liabilities which could occur during an Activity.

Clients are invited to contact their own insurance company for any complementary coverage from which they wish to benefit.

Force Majeure

If MEET THE LOCALS is unable to perform any of its obligations due to an event of force majeure as defined by statute or case law, it shall be exempt from that obligation. Shall be considered, in particular, as force majeure incidents: strikes, technical failure of the electricity or telecommunications networks, Internet access providers or hosting providers, etc., cases of natural disasters, bad weather, fire, storms, cyclones, earthquakes, tidal waves, floods, destruction by lightning, explosions, sabotage, embargo or worsening embargo, interruptions or delays in transportation or communications, acts or regulations issued by authorities public, civil or military (including delays in obtaining authorizations or permits of any kind), governmental or judicial decision preventing MEET THE LOCALS from meeting its contractual rights and obligations, epidemics, riots and revolutions, acts of piracy, acts of terrorism, nuclear accidents.

Severability

If one or more provisions of these Terms and Conditions is held to be invalid or declared as such under any law, regulation or following a final decision from a competent jurisdiction, the other provisions shall remain in full force and effect. If necessary, parties will agree to immediately remove and replace such provision with a valid and legally similar provision.

Dispute

Any dispute arising in connection with the execution or interpretation of these Terms and Conditions, failing to having previously been subject to an amicable settlement between the parties, shall only be submitted to the competent jurisdiction pertaining to the locality of MEET THE LOCALS’ headquarters (Pontoise (postal code: 95300) – France).
